OPT and H-1B Visa Sponsoring

OPT

This is known as the Optional Practical Training, which is a period where international students in the United States with F-1 student visas can work in their field of study to gain practical experience. It is a form of temporary employment authorization that allows students to apply their academic knowledge in a real-world setting.

  • First step: the student requests an OPT recommendation from his/her/their DSO (Designated School Official) at his/her/their educational institution.
  • Second step: the student files Form I-765 (Application for Employment Authorization) with USCIS (U.S. Citizenship and Immigration Services), which they will process.
  • Third step: the student receives an EAD (Employment Authorization Document), which will specify the start and end dates of the OPT period.

H-1B

The process requires a U.S. employer to hire a foreign national to work in a specialty occupation in the United States. It is a non-immigrant visa that allows skilled workers to temporarily work in the U.S.

  • First step: a U.S. employer offers a job that is a specialty occupation, which generally requires a bachelor's degree or higher.
  • Second step: the employer files an LCA (Labor Condition Application) with the Department of Labor.
  • Third step: the employer files the H-1B petition to the USCIS, which they will receive and may approve.
